OPERATOR/PARTICIPANT CONTRACT AND REGISTRATION FORM
HOMERIC TOURS, INC. must receive the following "REGISTRATION
FORM AND CONTRACT" below signed by ALL the participants
listed on the form. Also, please fill in clearly ALL
requested information. This is extremely important
because all documents/tickets cannot be released if
this form is not properly signed, filled out and returned.

OPERATOR/PARTICIPANT
CONTRACT
1. This
agreement sets forth the terms and conditions pursuant
to which HOMERIC TOURS, INC., the Charter operator
("HTI") , located at 55 East 59th Street,
New York, N.Y. 10022 in return for payment by the
Charter Participant of the amount specified as the
charter price, agrees to provide to the subject charter
flights.
2. RESPONSIBILITY: HOMERIC TOURS, INC. The Charter
Operator, acts as a principal, and is responsible
to participant in making arrangements for all services
and accommodations offered in connection with these
charter flights, except that the Charter Operator
shall not be responsible, in the absence of negligence
on its part, for any act, error, omission, injury
to person, or property loss, inconvenience, accident,
delay, irregularity, or any other event which may
be occasioned through, or by reason of, negligence,
defect or default of any company, hotel, person, defect
air carrier, transfer company, sightseeing company
and /or their employees, servants, subcontractors
of facilities engaged in providing any of the services,
accommodations or facilities in connection with these
charters. WITH SPECIFIC REFERENCE TO FLIGHT DELAYS:
Flight delays are an unfortunate but inherent risk
of all air transportation, whether scheduled or charter,
and they are completely outside the control of the
Charter Operator. The Charter Operator shall have
no liability to the tour participant(s) of any nature
whatsoever relating to flight delays, including (but
not limited to) liability for damages relating to
shortened time, inconvenience or hardship, additional
expenses, or any other form of damage. Nor shall that
Charter Operator be liable to the tour participant(s)
for delays or other inconveniences resulting from
refueling stops. The direct carrier shall not be responsible
for any act, omission, or event during the time passengers
are not aboard its plane or conveyance. As permitted
by Provision 404(B) of Federal Aviation Act, Charter
Operator reserves the right, at its sole discretion,
to decline to accept or retain any person as participant
of any charter or tour at any time, without being
under any obligation whatsoever to assign any reason
therefore. In the event of the exercise of this right,
Charter Operator shall be under no liability to such
person(s), save to refund any monies received, or,
where the trip has already commended, to refund such
amount as Charter Operator, in its absolute and uncontrolled
discretion, deems reasonable to attribute to the uncompleted
portion of the trip. Charter Participant acknowledges
receipt of a copy of the brochure conditions herein,
by virtue of registering for, and making payment on,
one of these charter flights.
3. RESERVATION AND PAYMENT: A deposit of $100 and
a signed contract reservation form is required to
reserve a place on the charter or group flight. Each
passenger aged 18 years and over must sign the form;
a parent or legal guardian must sign for each passenger
under 18 years of age Final payment is due no later
than 35 days before departure. Payment in full must
accompany any application received less than 35 days
before departure. PAYMENTS MADE LESS THAN 25 DAYS
PRIOR TO DEPARTURE MUST BE MADE BY CERTIFIED CHECK,
CASH BANK TRANSFER, OR VIA WESTERN UNION. Check must
clear the escrow account at the Bank before the reservation
is considered VALID. If the charter is fully booked
when your reservation is received, you will be notified
immediately and, with your authorization, your name
placed on a waiting list pending cancellations. All
checks and money orders must be payable to: VALLEY
NATIONAL BANK/HOMERIC TOURS ESCROW ACCOUNT. If you
make a reservation on a Scheduled Airline, you may
make the check payable to HOMERIC TOURS and NOT to
Escrow Bank. (When the charter is sold to the Charter
Participant by a retail travel agent, checks and money
orders may be made payable to the retail travel agent.
The agent must in return make his check payable to
the depository account at the bank named above.) Any
other person or entity (including a travel agent)
who receives monies from Participant(s) does so strictly
as an agent for the Participant(s). The Charter Operator
disclaims liability for such monies until received
by Operator's office and confirmation is issued by
Operator. Tender of a deposit constitutes acceptance
of these terms and conditions
4. CHARTER PRICE: The charter price includes one way
from NEW YORK to ATHENS and return flight from ATHENS
to NEW YORK The charter price does not include the
United States and Greek Government and security tax.
5. INSURANCE: Trip cancellation, health, and accident
insurance is available to protect you against unforeseen
circumstances which may cause you to interrupt or
cancel your trip. Upon request, "HTI" will
provide you with details. "HTI" is not responsible
for loss, theft or damage to your belongings. Baggage
insurance is strongly recommended and is available
to nominal rates.
6. BAGGAGE: The direct air carriers limit their liability
for loss or damage to personal baggage.Such liability
shall be limited to the actual value of such baggage,
but shall not be more than approximately $9.07 per
pound in the case of checked baggage, and approximately
S400 per passenger for unchecked baggage or other
property. A higher value may be declared with respect
to the baggage in which case additional payment and
such declaration must be made in advance of departure
in accordance with the direct air carrier's application
tariff. There is a baggage allowance for charter passengers
as follows: a)One piece not exceeding 60 inches, b)
one additional piece not exceeding 55 inches(measure
length, plus width, plus height)if operational afctors
allow c) Additionally, each passenger may carry one
carry-on bag and one purse and/or briefcase to be
stored underneath seat that cannot exceed 8 inches,
plus 13 inches, plus 22 inches, equaling 43 inches
when added together. d)Any baggage spresent in excess
of the above will not be accepted by the airline
7. TRANSPORTATION: The flights will be performed using
a)For charters: North American Airlines Jumb Boeing
7670300 ER (12 seats in business and 266 seats in
economy class). b)Scheduled airlines, e.g. AIR FRANCE,
ALITALIA. or any other IATA carrier "HTI"
reserves the right to use a scheduled airline for
transportation in case of necessity "HTI"
and the air carrier reserve the right to substitute
any type of aircraft of any certified carrier, without
refund, but only to the extent permitted by the D.O.T.
regulations of Public Charters. In the event the airline
delays its departure, or is unable to perform, provisions
of Part 208 of the D.O.T. economic regulations will
apply. Flights during the off?season arc subject to
reprotection on any scheduled carrier and may require
a change of aircraft in Europe. Also, a different
type of aircraft may be used.
8. CANCELLATION AND REFUND POLICY: The Charter Participant
has the right to cancel his/her reservation and receive
a refund as set forth in the following schedule. All
requests for refund must be made in writing or telegraphic
notice to "HTI" at 55 East 59th Street,
New York, N.Y. 10022. If written notice of cancellation
is received by "HTI" for charter your cancellation
charges per person
Will be: up to 30 days or more before departure, $50
penalty; from 29 days to 15 days before departure,
$150 penalty; 14 to 3 days before departure, $250
penalty: 2 days or less before departure, 100% of
charges. All requests for refunds must be made through
the travel agent and submitted to the Operator within
15 days after completion of the flight, otherwise
no refund will be made. Processing of cancellation
refunds takes approximately 4?6 weeks. For charters
only, if a substitute is provided, or if a flight
is sold out, a full refund will be given, less $50
penalty. If transportation is solely on scheduled
airlines, the cancellation charge will be $175 per
person, at any time before departure from U.S.A. In
case passenger cancels the trip on or after the departure
date, there will be no refund. In the event the airline
delays its departure for more than 48 hours, or is
unable to perform, passenger has the right to cacel
and receive a full refund.
9. CHANGES BY PASSENGERS: The Charter Operator will
assess a $50 per person charge plus difference of
the fare for changes made by passengers in departure
dates or number of passenger traveling together, before
departure, from New York. Chargers made less than
30 days prior to departuer will be charged normal
cancellation fees as state above in section 8,plus
difference in fare.
10. PRICES: The Operator reserves the right to pass
on to the Charter Passenger costs resulting from fuel
increases, currency fluctuation, increased ground
service costs, adjustment in hotel prices, or any
item which results in a higher cost to the Charter
Operator. These costs will be passed on without the
right to cancel provided they do not constitute a
"major change"? in this instance, a price
increase to the passenger of more than 10%.
11. TRAVEL DOCUMENTS: Travel Documents will be mailed
approximately two weeks prior to departure, provided
Charter Participant Contract has been received, and
full payment has been made and cleared by our Bank.
ALL PARTICIPANT'S MUST BE PREPARED TO PRESENT A VALID
PASSPORT, WHICH MATCHES THE NAME ON THE PASSENGER
MANIFEST AND TICKET, WHEN BOARDING THE AIRCRAFT. IF
THEY DO NOT, FOR ANY REASON, THEY MAY HE DENIED BOARDING
WITHOUT REFUND.
ADDITIONAL
PROVISIONS APPLICABLE TO CHARTERS:
1. PROTECTION OF FUNDS: The payments of Charter Participants
are protected in part by a surety trust agreement
issued by CHASE LINCOLN FIRST BANK N.A. of ONE LINCOLN
FIRST SQUARE, ROCHESTER, N.Y. Unless a Charter Participant
files a claim with "HTI" at 55 East 59th
Street, New York, N.Y. 10022, or, if the Charter Operator
is unavailable, with the securer, within 60 days after
the completion of the charter, the securer shall be
released from all liability under the bond to that
Participant.
2. CANCELLATION: "HTI" reserves the right,
prior to the departure, to change the routing, the
itinerary, and to increase the price in the event
of price increases beyond its control in the component
parts of the charter, or substitute any hotel or ship
with another not named in the solicitation material.
The participant has the right to cancel and receive
a full refund within 14 days in the event of such
price increase being more than 10%, as well as itinerary
changes, provided that notice of such cancellation
is received by "HTI" within 7 days after
notification to the participants of the change. "HTI"
reserves the right to cancel the tour because of insufficient
participation, inability of the carrier to perform
the flight, or other circumstances that make it physically
impossible for the charter to be performed, within
10 days of the flight departure dates. If the charter
is canceled, participants shall automatically receive
a refund of all the monies paid on their behalf "HTI"
reserves the right to decline, accept, or retain any
charter monies. If a participant is removed from the
charter, the Charter Operator shall make a refund
for all unused services.
3. CHARTER TICKET: The Charter Ticket, which will
be issued to each participant, is valid for transportation
from USA to Greece with a fixed date of return to
the USA. CHANGES FROM ONE WESTBOUND FLIGHT TO ANOTHER
ARE NOT PERMITTED. Also, Charter Tickets are not transferable
and they have no refund value. Refunds will not be
made for any unused air transportation portions after
the departure date from USA.
4. CHECK?IN: Failure to check in At least three hours
may result in denial of boarding, and no refund will
be granted.
